Design objections and refusals: identify the correct procedure
The word objection can describe different stages of a design matter. An office refusal and a third-party challenge may call for different responses. We start with the communication itself and the design record.
Two design procedures, different instructions
Oppose another owner’s published design
Identify the published registration, publication date and the designs you challenge. Send your relied-on earlier designs or other evidence, with dated publication or disclosure records. We assess the available grounds and prepare the agreed challenge within the applicable three-month publication period.
Challenge a refusal of your own design application
Send the complete refusal decision, notification record, application number and filed views. We identify the refused items, the stated reason and the administrative review route. The appeal period is two months from notification of the decision. A formal correction and an appeal against a refusal are distinct tasks.
If an objection has been filed against your own registration, send that communication too: answering the objection is a separate instruction from bringing a challenge against someone else’s design.
Match the evidence to the stated ground
Where earlier designs are cited, identify the views and features being compared and provide dated disclosure records. For a formality issue, identify the missing or inconsistent item in the filed record. The evidence and response should answer the actual ground.
