PRACTICAL SERVICE GUIDE

PCT national phase entry in Turkey: the instruction checklist

A PCT application provides an international filing framework; national phase entry continues the application before the relevant national office. For Turkey, the published application, priority information and any amendments should be checked together before arranging local entry and translation.

30-month entry and the additional-fee route

The ordinary Turkish national phase deadline is 30 months from the earliest priority date, or the international filing date if no priority is claimed. WIPO’s Turkey chapter also provides entry up to 33 months from that date if the fee for requesting an extension of time is paid. This route involves an additional fee; it is not the ordinary entry period.

The estimator above shows the ordinary 30-month date only. If that date has passed or is close, send the PCT record promptly so we can check whether the additional-fee route is available and quote the correct entry work. The Turkish translation must also be planned: the WIPO guide provides a two-month period from national phase entry for furnishing it.

Agree the national phase entry package

Which text should be used?

Identify the published PCT application and any amendments intended for Turkish entry. Send the priority record, applicant details, international reports and the complete description, claims, abstract and drawings.

What does an entry quotation include?

The quotation should identify entry work, translation, official entry fees and any extension request fee. Later examination responses and annuities are separate tasks unless expressly included.

Documents to send for an assessment

  • PCT publication and application numbers
  • earliest priority date
  • description, claims, drawings and abstract
  • applicant details
  • amendments and international search or examination documents

What our representation covers

Check the application record and intended text, identify Turkish translation requirements, prepare entry documents and report the national filing reference. We distinguish entry formalities from later examination response work.

Costs and the written quotation

The quotation depends on specification length, amendments, translation, applicant changes and the entry stage.

Confirm national entry work, Turkish translation and any extension-related fee separately. Later examination and annual fee instructions are outside entry work unless expressly agreed.

What happens after the instructed action?

After entry, Turkish prosecution and fee obligations require attention. The text used for entry should correspond to the agreed application record. A later ownership change or amendment may call for further documents and separate instructions.

Does filing a PCT application automatically produce a Turkish patent?

No. The international phase and the Turkish national phase are separate procedural stages. National entry requirements and subsequent examination must be considered before treating the invention as protected by a granted Turkish patent.

FOR OVERSEAS APPLICANTS AND IP FIRMS

Plan your Turkish national phase instruction

Identify the application text

Send the published PCT application and identify any amendments intended for national entry. Include the description, claims, abstract and drawings rather than only a publication link.

Separate entry and translation work

Tell us whether you need a Turkish translation, have an existing translation for review, or want entry work only. The quotation should identify the agreed text, translation scope and filing work.

Agree post-entry responsibilities

Confirm who will receive the filing report and later office communications. Examination responses, applicant changes and patent annuities require their own agreed scope.

Instruct through your overseas firm

Provide your client reference and billing contact. Agree recipients and reporting requirements before the local instruction is accepted.
