HOW WE HANDLE YOUR MATTER

An opposition was filed against your Turkish mark: how to respond

01

Read the opponent’s claim

We identify each earlier mark or right relied on, the challenged goods or services and any evidence supplied with the opposition.

02

Assess possible answers

The comparison of signs and goods, the record of use where relevant, and any appropriate limitation are assessed in the context of your actual application.

03

Confirm the notified date

The response period is linked to the official notice. Send the full communication and attachments so the procedural position can be checked before instructions are given.

PRACTICAL SERVICE GUIDE

Defending a trademark application against an opposition

An opposition is a third-party challenge. The opponent’s rights, pleaded grounds and evidence should be read before preparing the applicant’s answer. Similar wording alone does not describe every issue raised in the file.

Documents to send for an assessment

  • Opposition notice and attachments
  • application reference
  • full specification
  • opponent’s cited rights
  • relevant business records that answer the pleaded grounds
  • earlier correspondence

What our representation covers

Compare the marks and relevant goods or services, assess the grounds and evidence and prepare the agreed observations. We identify which records are useful to the response and which questions need further instructions.

Costs and the written quotation

The quotation depends on the opposition grounds, the number of cited rights, the evidence to review and any translation needed.

For respond to a trademark opposition in turkey, confirm the specific filing or response task and documents to be reviewed. The agreed quotation identifies professional work, applicable official charges, translation needs, taxes and payment currency; later stages require separate instructions.

What happens after the instructed action?

The decision may affect only part of the application. Any further review or negotiation requires a separate assessment of the result and available options.

Is an opposition the same as a final refusal?

No. It is a challenge to the application. The procedural stage, opportunity to respond and eventual office decision must be distinguished.

Can I request proof of use of the opponent’s mark?

For an opposition based on likelihood of confusion, proof of use may be requested where the relied-on mark had been registered for at least five years at your application’s filing or priority date. The relevant evidence concerns genuine use in Turkey in the preceding five-year period, or proper reasons for non-use. This is not an automatic requirement in every opposition; send the notice and cited registrations so the eligibility and procedural timing can be checked.
